General Terms and Conditions of Swiss Grow Connection

1. General provisions

These general terms and conditions (hereinafter "GTC") regulate the use of the Swiss Grow Connection websites and the purchase of products and services. By purchasing products and services, the customer declares that he has read and accepted the GTC. The GTC form an integral part of the purchase contract concluded between Swiss Grow Connection and the customer.

Provisions deviating from the General Terms and Conditions are only binding if they are confirmed in writing by Swiss Grow Connection. Conflicting conditions of the customer are not accepted. By placing an order, the customer confirms that he is at least 18 years old and capable of acting at the time of the order.

2. Legal framework

The products and services offered by Swiss Grow Connection comply with Swiss legal regulations and are not subject to the Narcotics Act (BetmG).
Our products, which are classified as tobacco substitutes, are duly notified to the Federal Office of Public Health (FOPH) and registered and taxed with the Federal Customs Administration. They are sold in the same way as other tobacco products.

3. Products and Services

3.1 Customer's responsibility

Our products can be sold in certain countries as raw material or for certain applications. The customer is responsible for informing themselves about the legal situation and usage requirements in the respective importing country. Swiss Grow Connection assumes no liability for improper use or violations of applicable law in the importing country.

3.2 Limitations of use

Swiss Grow Connection products are not medicinal products. Customers should not stop or change medical treatments without consulting a doctor. Advice on medical or therapeutic applications is only given by qualified professionals.

3.3 Analysis orders

Analysis orders are only valid for the respective recipient and the associated report number. Manipulation or unauthorized distribution of analysis reports will be treated as forgery and may result in legal consequences.

4. Conclusion of contract

If delivery is impossible or only partial after conclusion of the contract, Swiss Grow Connection is entitled to withdraw from the contract or parts of it. In this case, Swiss Grow Connection is not obliged to provide replacement deliveries.

5. Delivery conditions

Delivery is made by handing over the goods to the customer, the Swiss Post or a common courier service.

• Costs: The customer bears the delivery costs. For orders over CHF 800.00, delivery within Switzerland is free.
• Delivery times: In Switzerland, delivery usually takes place within 3 working days. Delivery times abroad may vary.
• Inspection: The customer is obliged to inspect the goods upon receipt and to report any defects in writing within 3 days.

Returns are at the customer's expense and risk. Products must be returned in their original packaging and with a delivery note to the specified address.

6. Prices

• The prices of the products correspond to the prices valid on the day of the order. All prices are exclusive of VAT.
• Deliveries abroad are subject to the taxes and customs duties of the respective recipient country.
• Swiss Grow Connection reserves the right to adjust prices at any time. However, orders that have already been confirmed will be charged at the prices applicable at the time of the order.

7. Payment conditions

Unless otherwise agreed, payment is made in advance.

8. Retention of title

The goods remain the property of Swiss Grow Connection until full payment has been made. After 60 days, a default interest rate of 3% will be charged on the total invoice.

9. Return

Returns are possible in the case of incorrect deliveries or defective products. The return must be reported in writing within 3 days. Transport damage must also be reported within this period, otherwise the right to compensation expires.

10. Data Protection

Swiss Grow Connection adheres to the legal provisions of the Swiss Data Protection Act and the EU General Data Protection Regulation (GDPR).

• Personal data will be treated confidentially and will not be passed on without consent.
• Cookies may be used for statistical and functional purposes, but do not contain any personal data.

11. Copyright

All content, images, logos and graphics on the Swiss Grow Connection website are protected by copyright and may not be used without permission.

12. Liability

Swiss Grow Connection accepts no liability for damage resulting from improper use of the products. Swiss Grow Connection is not responsible for delays or failures due to force majeure.

13. Place of jurisdiction

Swiss law applies to all legal relationships. The place of jurisdiction is Bern. The UN Convention on Contracts for the International Sale of Goods is expressly excluded.
